Terms and Conditions of Use

The Durham Alumni Career Network (the ‘Network’) of which 'The Mildert Link' is a member, is comprised of a series of College-specific webpages for the purpose of connecting alumni and current students of the University to allow them to communicate and share career-related information.

Access to the Network is restricted for use to current students of the University (‘Student Users’) and alumni of the University (‘Alumni Users’), in accordance with these terms and conditions (the ‘Terms’). Use of the site by any other individual or organisation is strictly prohibited.


Alumni Users of the Network have volunteered to share their career experiences and insight about occupations, industries, employers, labour market trends, and recruitment experience with Student Users. The purpose of the Network is not to find jobs or internships, recruit employees, sell products or services, or conduct surveys, but rather to network and share career information within the University and College communities and their alumni.

In registering or logging into the Network at any time, Users hereby agree with the University to abide by the following Terms and Conditions at all times:


1. Student Users hereby agree the following:

a) Student Users are granted access to the Network by the University only for the purposes of seeking insight into industries and professions, and gaining other career-related information and guidance (the ‘Permitted Purpose’). However, Student Users acknowledge that the Network is not a job-finding service of any kind, and they are not permitted to request employment from any User.

b) The University reserves the right to deny Student Users access to the Network at any time and for any reason. The University is under no obligation to disclose any reasoning behind any denial of access to a Student User.


c) Student Users agree that they may enter into correspondence with Alumni Users via the Network.


d) Student Users agree that should they choose to correspond with Alumni Users via the Network, they shall restrict the topic of such correspondence only to the Permitted Purpose, and that any such contact with an Alumni User via the Network shall be made in a polite, appropriate manner, and  that they will not transmit any material that is obscene, defamatory, threatening, harassing, abusive, hateful or embarrassing to any other user, person or entity, nor transmit any sexually-explicit images or statements, advertisements or solicitations of business via the Network.


e) Student Users acknowledge that an audit trail of correspondence sent to Alumni Users via the Network is recorded and may be reviewed by the University.


f) Student Users acknowledge that Alumni Users are offering their help via the Network free of charge, in their own time, and are under no obligation to respond.

g)
The University makes no guarantee as to the accuracy, completeness or reliability of information provided by Alumni Users via the Network. Student Users are solely responsible for any use of, or reliance on any such information, and do so at their own risk.

 

2. Alumni Users hereby agree to the following:

a) By submitting information to the Network, Alumni Users agree to be contacted by email via the Network, by Student Users for the purpose of seeking insight into industries and professions, and gaining other career-related information and guidance. Alumni Users may respond to such correspondence at their own discretion. However, should they choose to respond to such correspondence, they agree to do so in a polite, appropriate manner, and not to transmit any material this is obscene, defamatory, threatening, harassing, abusive, hateful or embarrassing to any other User, person or entity, not transmit any sexually-explicit images or statements, advertisements or solicitations of business via the Network.


b) Alumni Users acknowledge and agree that an audit trail of all correspondence sent electronically to them by Student Users via the Network will be recorded and may be viewed by the University.

c) If Alumni Users wish to be included in the Network, they acknowledge that to do so they must enter certain contact details, including a valid email address. These details will not be made available by the University to other Users of the Network or listed in any entry.


d) Alumni Users may not list any content, products, services or other information on the Network that, in the University’s sole determination, may be illegal under any applicable law, statute, ordinance, rule or regulation, that may infringe or violate the rights of any individual or, the that the University believes, in its sole discretion, is discriminatory, inflammatory, offensive, or otherwise inconsistent with the spirit of the Network and the University.


e) The University reserves the right, at its sole discretion, to decide whether, where and how any information relating to an Alumni User may appear on the Network.


f) Alumni Users acknowledge that information included on the Network will be contained behind a secure log-in and will contain no confidential information.


g) Where Alumni Users submit information to the Network or enter into correspondence with Student Users, they agree to ensure that such information is accurate and truthful.


h) Alumni Users may change the information included on the Network at any time by logging into www.dunelm.org.uk and updating
their user profile. Alumni Users acknowledge, however that such changes may take up to three working days, subject to the information being approved and validated by the University.


3. All Users agree:

a) Acceptance of these Terms and Conditions is a condition of gaining full access to the Network.

b) The University reserves the right, at any time, to review any listing or information submitted to the Network for compliance with these Terms. Should any listing or information, at the sole discretion of the University, be found not to comply with these Terms, the University may remove or delete such listing or information from the Network without notice to the User.


c) All Users acknowledge that the Network may contain information, data, photographs, graphs, videos, typefaces, graphics, music, sounds, or other material (collectively ‘Content’) that may be protected by copyrights, trademarks, trade secrets, or other proprietary rights, and that these rights are valid and protected in all forms, media and technologies existing now or hereinafter developed. Therefore a User may not:


i) Modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit any of the Content, in whole or in part;


ii) Copy, upload, post, reproduce, republish, transmit or distribute in any way Content protected by copyright, or other proprietary right, without obtaining permission of the owner of the copyright or other proprietary right;


iii) Mirror any material contained on the website on any other server;


iv) Frame or utilise framing techniques to enclose any trademark, logo or other proprietary information (including images, text, page layout, or form) of the University without express written consent; or


v) Use any metatags or any other ‘hidden text’ utilising the University’s name or trademarks without the express written consent from the University.


d) The University grants Users a limited, non-exclusive, non-transferable personal licence to access and display the Content on the Network for personal, non-commercial use only, subject to these Terms. This licence is conditional on User continued compliance with the Terms. All rights not expressly granted herein are reserved.


e) All Users agree to hold harmless, the University, its officers, directors, representatives, employees, students, agents, third-party content providers, merchants, sponsors and licensors from any claim or demand, including legal fees, made by any third party arising from the use of the Network, the acceptance/rejection of an Alumni User’s listing or a Student User’s search, any alleged violation of these Terms, or any alleged violation of the rights of any other individual or organisation.


f) Users must never disclose their username or password to the Network to any other individual or organisation.


g) The University warrants to Users that all Personal Data (as defined in the Data Protection Act, 1998) provided to the University in order to access the Network, shall be handled by the University strictly in accordance with said Act as amended, and with the provisions of any other applicable data protection legislation.


h) The University may terminate a User’s access to the Network and remove or discard any Content therein for any reason, including, without limitation if the University believes, in its sole discretion, that a User has violated or acted inconsistently with the Terms. The University may also in its sole discretion and at any time discontinue providing the Network, or any part thereof, with or without notice. Users agree that any termination of access to the Network may be effected without prior notice, and acknowledge and agree that the University may immediately deactivate or delete a User’s account and all related information and files therein and/or bar any further access to such files or the Network. Further, Users agree that the University shall not be liable to Users or any third party for any termination of access to the Network.


i) Users may terminate the use of the Network at any time by deactivating their profile. The University reserves the right to terminate a User’s access, without notification, for non-adherence to any of the rules set forth in these Terms.


j) The University reserves the right to amend these Terms, and to modify, add, or discontinue any aspect, content, or feature of the Network. Such amendments, modifications, additions, or deletions shall become effective upon notice thereof, which may be provided to Users by a statement on the Network, via email or any other reasonable means. Continued use of the Network following such a notice, shall be deemed to indicate a User’s acceptance of any such amendments, modifications, additions or deletions.


k) These Terms constitute the entire agreement between Users and Durham University regarding use of the Network and shall govern a User’s use of the Network, superseding any prior agreements between the University and the User.


l) This Agreement shall be governed by the laws of England and Wales, and shall be subject to the exclusive jurisdiction of the English courts. The failure of Durham University to exercise or enforce any right herein shall not constitute a waiver of such right or provision.


Should any User be unhappy with any correspondence received via the Network or any Content therein, it should be reported to the University immediately by email to
alumni.office@durham.ac.uk. The University shall take any such action they see appropriate following such a complaint.
